In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted under your account, and that you will comply with all applicable local, state, national and international laws and regulations, including but not limited to United States export restrictions, that relate to your use of or activities on the Services. The Services are controlled and operated in the United States and Puerto Rico. If you are in a jurisdiction that restricts you from accessing or using the Services, do not access or use the Services.

The Services may contain areas where you may post and share comments with other Services users on a variety of subjects. All content available through the Services, including but not limited to data, quotes, status reports, technical drawings, configurations, order information, and catalog listings is believed to be accurate. We may use your Inputs to provide, maintain, develop, train, and improve the Services and its features (including AI-enabled features), to develop new products and services, to comply with applicable law, to enforce our terms and policies, and to keep the Services safe. We may use any Outputs of AI-enabled features for any purpose whatsoever.

GE APPLIANCES AND ITS BUSINESS PARTNERS ASSUME NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY A USER, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA FROM DELAYS, NONDELIVERIES OF CONTENT OR EMAIL, ERRORS, SYSTEM DOWN TIME, MISDELIVERIES OF CONTENT OR EMAIL, INACCURACY OF OUTPUT OF AI-ENABLED FEATURES, NETWORK OR SYSTEM OUTAGES, FILE CORRUPTION, OR SERVICE INTERRUPTIONS CAUSED BY THE NEGLIGENCE OF GE APPLIANCES OR ITS BUSINESS PARTNERS OR THEIR LICENSORS, OR A USER'S OWN ERRORS AND/OR OMISSIONS.

GE APPLIANCES AND ITS BUSINESS PARTNERS DISCLAIM ANY WARRANTY OR REPRESENTATION THAT THE CONFIDENTIALITY OF INFORMATION TRANSMITTED THROUGH THE SERVICES WILL BE MAINTAINED.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

UNDER NO CIRCUMSTANCES, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE, SHALL GE APPLIANCES, ITS BUSINESS PARTNERS, VENDORS, OR SUPPLIERS (OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS) BE LIABLE FOR ANY CLAIM BY ANY PARTY OTHER THAN GE APPLIANCES FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF OR THE INABILITY TO USE THE SERVICES OR ANY CONTENT CONTAINED ON THE SERVICES, OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR OTHER INFORMATION THAT IS SENT OR RECEIVED OR NOT SENT OR RECEIVED, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Orders are subject to product availability. We try to fulfill all orders, but sometimes an item described on the Services is not available. Applicable Law. These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without giving effect to conflicts of laws provisions. Except as provided in the section of these Terms entitled Dispute Resolution, any disputes or claims arising from or related to the Services or these Terms of Use shall be governed exclusively by Puerto Rico law. All disputes arising hereunder shall be resolved through arbitration in Puerto Rico, in accordance with the applicable arbitration rules, except for claims related to breaches of confidentiality as otherwise specified.

Other. These Terms of Use are not intended to alter the terms or conditions of any other agreement you may have with GE Appliances or its Business Partners to the extent that those agreements govern issues other than your use of the Services, nor any agreements that they may have with one another.

English Language. You agree that there shall be no requirement to translate any of the Services, or any portion thereof or content thereon, into any language other than the one(s) in which they appear. All contractual and transactional communications shall be in the English language, and there shall be no requirement to translate any communication into any other language.

Resale. Using the Services to purchase products or services for resale is prohibited.

Enforceability. Should any provision in these Terms of Use be found invalid or unenforceable for any reason, that provision shall be deemed severable from the other provisions and shall not affect the validity or enforceability of the remaining provisions. You agree that any claim arising out of or related to these Terms of Use or your use of the Services must be filed within one year after it arose or be permanently waived.

Dispute Resolution. Any dispute, claim, or controversy arising out of or relating to your use of the GE Appliances Puerto Rico Online Store or any purchase of GE Appliances products or services shall be resolved exclusively through binding arbitration, except for claims by GE Appliances related to credit card misuse, dishonored payments, breaches of confidentiality, or other similar matters.

Arbitration shall proceed as follows:

• For disputes involving an amount in controversy under $3,500, the matter shall be arbitrated by the Better Business Bureau (BBB) in accordance with its applicable rules and procedures.
• For disputes involving an amount in controversy of $3,500 or more, the matter shall be arbitrated by the Center for Public Resources (CPR) in accordance with its applicable rules and procedures.

Arbitration may be conducted remotely or, where applicable, in Puerto Rico. Each party shall bear its own costs and expenses associated with the arbitration process. Nothing in this clause prevents a consumer from filing a claim before any Puerto Rico administrative agency when permitted by applicable law.

Governing Law. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Delaware, to the extent such laws do not conflict with the public policy or mandatory consumer protection provisions of the Commonwealth of Puerto Rico.

Judicial Proceedings. For claims brought by GE Appliances against you—such as misuse of payment methods, breaches of confidentiality, or similar matters—you agree that GE Appliances may pursue such claims in a court of competent jurisdiction. However, nothing in this clause shall be interpreted to waive or limit any rights granted to consumers under the laws of Puerto Rico.

In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted under your account, and that you will comply with all applicable local, state, national and international laws and regulations, including but not limited to United States export restrictions, that relate to your use of or activities on the Services.
